Terms of Use

Rules governing accounts, marketplace transactions, listings, payments and acceptable use.

Please read carefully. By creating an account, using AMAKET, listing goods, placing an order, using Sales Point, communicating through the platform, or otherwise accessing our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use, our Privacy Policy, and the policies linked on this site. If you do not agree, do not use AMAKET.

1. Eligibility, authority and acknowledgment

You confirm that you are legally capable of entering a binding agreement, that information you provide is complete and accurate, and that you will keep it current. If you use AMAKET for a business, you confirm that you have authority to bind that business. You are responsible for ensuring that your use of the platform, listings, products, payment activities and deliveries comply with all applicable laws, licences, taxes, permits and regulatory requirements.

2. AMAKET’s role as a marketplace

AMAKET provides digital marketplace, transaction-record, communication and operational tools. Unless AMAKET expressly identifies itself as the seller of a particular item, the seller—not AMAKET—is the supplier of that item. Couriers are independent delivery partners responsible for their delivery services. AMAKET does not take title to sellers’ goods, manufacture listed products, or guarantee the conduct, quality, legality, availability, safety or fitness of every product, seller, buyer, courier or third party.

3. Account security and responsibility

You are responsible for all activity performed through your account, including actions by staff you create or authorise. Keep passwords, devices, payment credentials and OTPs confidential; AMAKET staff, sellers and riders will never need your password or OTP. Notify us promptly of suspected unauthorised access. We may require identity checks, restrict access, reverse or hold activity, or suspend an account where reasonably necessary to protect users, investigate risk, comply with law or enforce these Terms.

4. Listings, product information and seller duties

Sellers must list only lawful goods that they have the right and capacity to sell. Listings must be accurate, current and not misleading, including product condition, specifications, variants, price, stock, warranty, photographs, delivery terms and restrictions. Sellers remain responsible for product safety, recalls, taxes, representations, fulfilment and all legally required disclosures. AMAKET may remove, limit, reject or require changes to any listing without creating an obligation to review or approve other listings.

5. Orders, prices and availability

A cart, product display or order request does not guarantee availability or acceptance. The checkout record identifies the agreed item, quantity, price, delivery option and other charges, subject to correction of a genuine obvious error, fraud, legal restriction, stock failure, duplicate transaction or payment failure. Sellers and AMAKET must not use misleading prices or hidden charges. Where a lawful correction or cancellation is needed, affected users will be notified and any eligible refund will be handled through the applicable process.

6. Payments, fees and payouts

Payment processing, verification and withdrawals may be performed by regulated third-party providers. You authorise AMAKET and its providers to process instructions connected with your use of the platform. Seller and courier balances are ledger records, not bank deposits; they may be subject to verification, reserves, commissions, delivery funding, refunds, reversals, chargebacks, taxes and fraud review. A payout may be delayed, rejected or reversed where required for security, compliance, a dispute, an error or a payment-provider rule. You must maintain accurate, verified payout details.

7. Delivery, risk and confirmation

Delivery estimates, courier availability and tracking events are operational estimates, not guarantees. Buyers must provide a correct and accessible delivery address, valid contact details and reasonable receipt arrangements. Confirm receipt only after physically receiving and inspecting the relevant order. Sellers must package goods safely and hand over only properly processed orders; couriers must record material delivery stages honestly. Risk, delivery obligations and consumer remedies remain subject to applicable law and the terms presented at checkout.

8. Returns, refunds, complaints and evidence

Use the designated order, return or support flow for a problem. Provide truthful, relevant and timely information, preserve packaging and items where practical, and submit clear evidence when requested. AMAKET may consider platform records, payment records, messages, photographs, tracking history and other available evidence to facilitate a resolution. A platform review is not a court judgment and does not prevent a user from exercising non-waivable statutory rights. Do not return goods, issue a refund, or arrange off-platform settlement contrary to approved instructions where this could compromise the investigation.

9. Prohibited conduct

You must not commit fraud; sell prohibited, stolen, counterfeit, unsafe or infringing goods; manipulate prices, reviews, orders or disputes; abuse refunds or chargebacks; impersonate another person; scrape or misuse data; circumvent fees or security controls; introduce harmful code; harass users or staff; publish unlawful content; or use personal information received through AMAKET for any purpose other than the relevant transaction. We may preserve evidence and cooperate with lawful requests from regulators, payment providers and law-enforcement agencies.

10. Data, communications and electronic records

You consent to receive notices, receipts, security alerts and operational communications electronically through AMAKET, email, SMS or other contact details you provide. Electronic records, timestamps, platform logs, payment references and communications may be used as evidence to the extent permitted by law. Our handling of personal information is described in the Privacy Policy. Users must protect personal information obtained through a transaction and may use it only as necessary to complete that transaction or meet a legal duty.

11. Intellectual property and user content

AMAKET and its logos, software, design, content and platform materials are protected by applicable intellectual-property laws. You retain ownership of content you lawfully submit, but grant AMAKET a non-exclusive, worldwide, royalty-free licence to host, reproduce, adapt, display and distribute it as necessary to operate, secure, improve and promote the platform. You represent that your content does not violate law or another person’s rights, and you remain responsible for it.

12. Suspension, restriction and termination

AMAKET may, with or without prior notice where reasonably necessary, suspend, restrict, remove content, cancel an affected transaction, freeze a balance or terminate access for suspected fraud, security risk, unlawful conduct, repeated poor performance, breach of these Terms, abuse of staff or users, regulatory obligation or protection of the platform. Where practicable, we will explain the action and provide an appropriate review path. Termination does not remove obligations already accrued, including payment, refund, evidence-preservation and dispute obligations.

13. Indemnity

To the fullest extent permitted by law, you agree to defend, indemnify and hold harmless AMAKET, its owners, officers, employees, contractors, agents and staff from claims, losses, liabilities, costs and reasonable legal fees arising out of your content, products, listings, breach of these Terms, unlawful conduct, misuse of the platform, or violation of another person’s rights. This does not require you to indemnify any party for liability that cannot lawfully be excluded.

14. Disclaimers and limitation of liability

The services are provided on an “as available” basis. To the fullest extent permitted by law, AMAKET does not warrant uninterrupted, error-free or secure service, or guarantee a transaction outcome, a third party’s performance, a product’s quality or suitability, or a delivery time. AMAKET and its staff are not liable for indirect, incidental, special, punitive or consequential loss, loss of profit, data or goodwill, or losses caused by independent sellers, couriers, payment networks, communications providers or events beyond reasonable control. Nothing in these Terms excludes liability, consumer protection, refund rights or other rights that cannot lawfully be limited or excluded.

15. Changes to these Terms, services and policies

AMAKET may update these Terms, platform features, fees, eligibility rules and policies from time to time to reflect legal, security, operational, commercial or service changes. We will publish the revised effective date and may provide additional notice for material changes. Changes apply prospectively from their stated effective date, except where law requires otherwise. Your continued use after that date is acknowledgment of the updated Terms. If you do not accept an update, you must stop using the affected service, subject to completing outstanding obligations and transactions.

16. Applicable law, disputes and general terms

These Terms are intended for use across AMAKET’s supported markets. They are governed by the applicable laws of the jurisdiction connected to the relevant user, transaction or service, including any mandatory consumer-protection, privacy, payments, tax, product-safety and electronic-commerce rules that cannot lawfully be excluded. Before commencing formal action, users should first submit the matter through AMAKET support and allow a reasonable opportunity for review. If a provision is unenforceable in a particular jurisdiction, it will be limited only to the extent required there and the remaining provisions remain effective. A failure to enforce a provision is not a waiver. These Terms, together with the applicable checkout record and linked policies, form the agreement between you and AMAKET concerning the service.

17. Prohibited and restricted items

To protect users, delivery partners and the marketplace, sellers must not list, advertise, sell, transfer or arrange delivery of unlawful, unsafe, stolen, counterfeit or otherwise prohibited goods. AMAKET may remove a listing, hold a transaction, restrict an account, preserve records or report suspected unlawful activity where reasonably necessary.

Never permitted
  • Illegal drugs, controlled substances and related paraphernalia.
  • Weapons, explosives, ammunition and prohibited dangerous materials.
  • Stolen goods, counterfeit goods or items that infringe intellectual-property rights.
  • Fraudulent documents, compromised accounts, financial credentials or tools intended for unlawful access.
  • Exploitative sexual content, child sexual abuse material or content facilitating harm.
Restricted goods
  • Regulated health products, medicine, food, cosmetics and medical devices.
  • Alcohol, age-restricted products, telecommunications equipment, chemicals and specialised equipment.
  • Any product requiring licences, age checks, location limits, compliant labelling or courier approval.
  • Unsafe, recalled, adulterated or unlawfully marketed products.

Sellers are responsible for every required authorisation, accurate product information and lawful fulfilment. This list is not exhaustive: a product may be removed where it creates a safety, legal, operational or reputational risk.
